Pre-adoption Attitudes and Trust in Artificial Intelligence for high-stake decision making: a case study of the Judiciary

Abstract
Artificial Intelligence (AI) is increasingly supporting or taking over decision making processes within organizations. While this is a logical move for organizations from a strategic perspective, it leads to new adoption challenges within organizations. Ethical concerns and the black box nature of algorithms fuel the societal debate on AI, which causes individuals to form attitudes towards AI before they are confronted with a specific tool within their organization. Within this case study of the Judiciary in The Netherlands, ten judges were interviewed to obtain qualitative data about their pre-adoption attitudes and trust towards AI. Building on the literature on innovation adoption and the literature on individual technology acceptance (with a focus on the concept of trust), it was found that individual attitudes towards AI are formed before an adoption decision has been made by the organization. These individual attitudes ultimately lead to individual usage intentions, which are crucial for the further course of the adoption process within the organization. Besides, automated high stake decision making indicates interdependencies on a contextual level: negative experiences from external organizations that operate in the same high stake decision making context have an impact on the attitudes of individuals towards AI adoption within their own organization. Next to that, the distinction between pre-adoption trust and post-adoption trust provides insights in interplay between individual factors (attitudes) and external factors (for example political pressure to increase efficiency) and how these factors can determine individual AI acceptance over time.
