From Policy to Practice: A Case Study on the Ethical Efficacy of the AI Act

Abstract
Therapid rise of AI technologies has highlighted the need for robust regu
latory frameworks. Both the AI Act and ISO/IEC 42001 are central efforts in
promoting safe and ethical AI, though concerns persist about their practical
efficacy. This study explores how alignment or divergence between these two
frameworks can inform improvements to mitigate ethical risks. To address
this question, I conducted a regulation analysis, followed by a practical case
study incorporating ethical analyses, culminating in an evaluation of current
mitigation actions and recommendations to enhance both frameworks. The
results show that both frameworks lack clarity on implementation, leading to
loopholes that threaten fundamental rights. Key gaps remain regarding sus
tainability, individual protections, and Eurocentric bias. Recommendations
therefore include enhancing conformity and fundamental rights assessments,
enforcing a true ban on AI systems with unacceptable risk, adding provi
sions regarding sustainability and worker protections, as well as penalties
for private individuals, and encouraging international cooperation.
